Terms and Conditions for Bartstua AS
1. The Agreement
The purchase agreement between you as the customer and Bartstua AS consists of these terms and conditions, the information provided in our ordering solution, and any specific agreements between the parties. In case of conflict, individual agreements take precedence, provided they do not contravene mandatory legislation.
2. The Parties
Seller (Provider): Bartstua AS (“Stu”), org. no. 927 525 348, e‑mail: support@stu.no
Buyer: The person (consumer) who places the order via our digital solutions.
3. Prices
All prices are stated inclusive of VAT and any fees unless expressly specified otherwise. No hidden costs will be incurred without being clearly shown before the purchase is completed.
4. Payment
Payment is made using the selected method at checkout. We accept bank cards (Visa, Mastercard, etc.), and the amount is charged when the order is placed.
5. Delivery
Services (sauna): For our sauna services (drop‑in, private rental, etc.) the service is considered delivered when you show up and use the reservation at our premises. It is the customer’s responsibility to arrive on time. Failure to appear without canceling within the deadline counts as a used session.
Gift cards: Digital gift cards are usually delivered immediately by e‑mail. Physical gift cards (if offered) are normally dispatched within 30 days by post unless another delivery time is specified. The risk of loss for a physical gift card passes to you once the gift card is received by you or your representative (for example upon delivery to your mailbox).
6. Safety and Liability
All bathing and sauna use is at your own risk. Children under 16 must be accompanied by an adult.
- Own responsibility: You are responsible for assessing your own health and tolerance for heat and cold water. Children under 16 must always be supervised by an adult.
- Health considerations: People with serious heart problems, high blood pressure, epilepsy, or other medical conditions that can be aggravated by intense heat or ice bathing should consult a doctor before using the sauna and should avoid ice bathing without medical advice. If you feel unwell, dizzy, or uncomfortable, leave the sauna immediately and cool down.
- Preferably swim with others: For safety, do not swim alone. If you plan to jump into the sea or ice bathe, always bring a bathing partner or have someone watch from land or the pier. Swim within a safe distance of the sauna and according to your own swimming ability. We encourage guests to follow the Norwegian Society for Sea Rescue’s official bathing guidelines.
- Hydration: Drink plenty of water during and after your sauna session to avoid dehydration. Alcohol is not allowed in the sauna because it increases the risk of dehydration and accidents.
- Follow the rules: Comply with all instructions and rules provided by Bartstua, whether posted on‑site or given verbally by our staff. Bartstua disclaims liability for accidents or injuries that occur if safety rules are not followed. Show consideration for other guests – use a towel on the benches, do not bring food into the sauna, and avoid behaviour that could disturb or endanger others.
- Belongings: Bartstua is not responsible for forgotten or stolen items. Keep valuables safe; anything you bring into the sauna or changing area is at your own risk.
By using our services you accept these safety conditions. Bartstua reserves the right to refuse or remove customers who grossly violate safety rules or otherwise act irresponsibly.
7. Right of Withdrawal and Cancellation
Exceptions from the right of withdrawal: Drop‑in and private bookings at Bartstua are leisure activities with a specific date and time and are therefore exempt from the right of withdrawal (Right of Withdrawal Act § 22 m).
Our flexibility policy:
- 100 percent refund if canceled at least 72 hours in advance. Please contact us at support@stu.no to request a refund.
- Rebooking is possible up to 48 hours before the original time and can be done through “my page”.
Gift cards and subscriptions: The ordinary 14‑day right of withdrawal applies under the Right of Withdrawal Act. You must notify us within 14 days after purchase if you wish to use this right. Outside the withdrawal period, gift cards are non‑refundable.
8. Delayed or Failed Delivery
We strive to deliver services and products at the agreed time. If we do not provide the service at the booked time and the reason is not on your side, you are entitled to demand performance or cancel the purchase if the delay is significant. For example, if the sauna is unavailable or we must cancel your booking for reasons within our control, you may choose to reschedule to another time or receive a full refund.
9. Defects and Complaints
If you believe the service or product you received is defective or does not match what was agreed, please notify us within a reasonable time after discovering the issue – for one‑off services such as sauna sessions, preferably the same day. If a service defect occurs (for example the facilities were not as promised), you have the right to appropriate remedies that may include a new sauna session at no extra cost, a proportional price reduction, or in serious cases cancellation with a full refund, depending on the nature of the defect and consumer law principles.
The two‑ or five‑year complaint periods in the Consumer Purchases Act mainly apply to physical goods intended to last over time. For services like our sauna experiences, any complaint period is limited to the booked time slot and a short period afterward. Contact us directly if you are dissatisfied; we will do our best to find a good solution.
10. Customer Liability for Damage
- The customer must treat Bartstua’s premises, furnishings, and equipment responsibly.
- If the customer, or persons for whom the customer is responsible (including fellow or guest bathers), causes damage through intent or negligence, the customer is liable for:
- necessary repair and cleaning costs
- documented lost rental income resulting from the sauna being closed for repair
- Normal wear and tear from ordinary use is not the customer’s responsibility.
- If the damage is discovered immediately, Bartstua may require the customer to pay on the spot or charge the registered payment method after written notice. Disputes over compensation claims can be brought before the Consumer Authority or the ordinary courts.
